THE VOID INDICTMENT

MUSCOGEE COUNTY SUPERIOR COURT INDICTMENT NUMBER SU04CR2103

Under GEORGIA law, Valid testimony must be heard on each presentment. An affidavit alone apparently is not sufficient to authorize the grand jury to return a true bill of indictment.
SWITZER V. STATE 7 GA. APP. 7 (1909)
If you look at the document entitled " INDICTMENT PAGE 1 " it clearly shows that NO WITNESSES was present before the grand jury.
ALSO PURSUANT TO O.C.G.A. 17-7-96, The arraignment and plea of the person accused of committing a crime SHALL be entered on the indictment or accusation by the prosecuting attorney or other person acting as prosecuting officer of the state.
Document "INDICTMENT PAGE 1" clearly shows that NO BODY signed the indictment.
Until arraignment and plea, there is no issue between the state and the prisoner. It is conceded on all hands, that there had been in this case NO ARRAIGNMENT OF MR. CHATMAN HIMSELF nor a LEGAL WAIVER of it. There could consequently be no plea to the indictment. The empanneling of the jury then was, merely an IRREGULARITY. See BRYANS V. STATE 34 GA. 323 (1866)
